Adobe Lightroom Presets License Agreement
This License Agreement ("Agreement") is entered into between Fox & Wildling Photography Pty Ltd, hereinafter referred to as "Licensor," and the individual or entity that has acquired the Lightroom Presets Pack, hereinafter referred to as "Licensee." This Agreement governs the use of the "WILD - Preset Pack", hereinafter referred to as the "Product."
1. Grant of License: Licensor grants Licensee a non-exclusive, non-transferable license to use the Product for personal or commercial use, in accordance with the terms and conditions of this Agreement.
2. Usage Rights: (a) Licensee is permitted to use the Product to enhance their own photographic works, projects, or images. (b) Licensee may use the Product for both personal and commercial purposes. (c) Licensee is allowed to modify and adapt the Presets to suit their creative needs.
3. Prohibited Actions: (a) Licensee may not resell, distribute, sublicense, rent, lease, or lend the Product. (b) Licensee may not claim ownership or authorship of the original Presets or distribute derivative works based on the Product. (c) Licensee may not incorporate the Product into any online or offline template or generator.
4. Ownership and Copyright: (a) The Product, including all intellectual property rights, remains the sole property of Licensor. (b) The Product is protected by copyright laws and international treaties.
5. Transfer of License: The license granted under this Agreement is non-transferable. Licensee may not assign, sublicense, or transfer their rights to any other party.
6. Limitation of Liability: (a) The Product is provided "as is," without any warranties or guarantees of any kind. (b) Licensor shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Product.
7. Termination: (a) This license agreement is effective until terminated. It will terminate automatically if Licensee breaches any of the terms outlined in this Agreement. (b) Upon termination, Licensee must cease using the Product and destroy all copies in their possession.
8. Governing Law: This Agreement shall be governed by and interpreted in accordance with the laws of [Your Jurisdiction], without regard to its conflict of laws principles.
By using the Product, you acknowledge that you have read this license agreement, understood its contents, and agreed to be bound by its terms and conditions.
